YOUR ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Blancsom does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use Blancsom only with involvement of a parent or guardian. Blancsom reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

Where this site permits, visitors may post reviews, comments, and other content; send communications and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." If you do post content or submit material, and unless we indicate otherwise, you grant Blancsom a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Blancsom and its sub licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Blancsom for all claims resulting from content you supply. Blancsom has the right but not the obligation to monitor and edit or remove any activity or content. Blancsom takes no responsibility and assumes no liability for any content posted by you or any third party.

BLANCSOM REWARDS PROGRAM

Participation & Eligibility

The Blancsom Rewards Program is a rewards program offered by Blancsom to its customers located in the U.S. (domestic, excluding Alaska and Hawaii) and Canada. Participation in the Blancsom Rewards Program is limited to individuals only and is limited to one account per individual. Individuals participating in the program on behalf of companies will be removed from the program. You must be age 13 years or older and a legal resident of the United States or Canada to be eligible for participation in the program. Eligible minors must obtain their parent’s or legal guardian’s consent prior to participation.
By registering with Blancsom.com, you agree (or, if you are a minor, your parent or legal guardian agrees) to be bound by these terms and conditions. Only registered members of Blancsom are eligible for participation in the rewards program. No purchase is necessary to become a member. The rewards program is void where prohibited by law. Participation in the Blancsom Rewards Program does not confer any rights or benefits in the program of any other company or Blancsom affiliate.

Earning and Redeeming Blancsom Rewards Points

Under the Blancsom Rewards Program, you earn 10 rewards points for every $1 (USD) spent on merchandise (excludes taxes and/or shipping) on Blancsom.com. Points can be redeemed only after an account holder has accumulated at least 5,000 rewards points. 5,000 rewards points, when redeemed towards a purchase on Blancsom.com, will discount $5 (USD) from the purchase. 10,000 rewards points, when redeemed towards a purchase on Blancsom.com, will discount $10 (USD) from the purchase, and so on. However, points have no cash value, and points are never redeemable for cash. Reward points are solely eligible for use on Blancsom.com (online). Points can only be redeemed towards purchases on Blancsom.com.
Points earned from a purchase that is later returned or cancelled will be taken off your account. If you use points towards a purchase that is later returned or cancelled, the points will reappear in your account, and you will be refunded the amount spent on that particular order, excluding the discount provided by the points used. Points will be returned to your account only when the order returned or cancelled is returned or cancelled in accordance with the policies outlined in these Terms & Conditions.

Changes, Termination and/or Removal from Rewards Program

Blancsom reserves the right to change the rules, regulations, benefits, eligibility for participation, or any other feature of the rewards program at its sole discretion. Blancsom may also, in its sole discretion, terminate the rewards program any time by posting the termination on the Blancsom website.
Blancsom reserves the right to exclude individuals from the Blancsom Rewards Program in its sole discretion. Any abuse of the rewards program, failure to follow any terms of the program, membership inactivity for more than 365 days, any misrepresentation or any conduct detrimental to the interests of Blancsom may subject registered members to membership revocation and will affect eligibility for further participation in the Blancsom Rewards Program. If your membership is revoked or otherwise cancelled, any points in your account will automatically expire. Points are non-transferable and can only be used by the individual registered to that account. Blancsom reserves the right to make changes to Blancsom.com and these Terms at any time. It is your responsibility to check or review these Terms to keep informed of any changes. By registering with Blancsom, you hereby agree to be bound by any such changed Terms.

Limitation of Liability

BLANCSOM WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON BLANCSOM’'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN WILLINGLY AGREES) THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM BLANCSOM AND THAT THIS IS A REASONABLE ALLOCATION OF RISK.

Blancsom respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please follow our Notice and Procedure for Making Claims of Copyright Infringement.

RISK OF LOSS

All items purchased from Blancsom are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

PRODUCT DESCRIPTIONS

Blancsom attempts to be as accurate as possible. However, Blancsom does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current or error-free. If a product offered by Blancsom itself is not as described, your sole remedy is to return it in unused condition.

PRICING

Except where noted otherwise, the List Price displayed for products on our Web site represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day.

With respect to items sold by Blancsom, we cannot confirm the price of an item until you order; however, we do NOT charge your credit card until after your order has entered the shipping process. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

APPLICABLE LAW

By visiting Blancsom, you agree that the Federal Arbitration Act, applicable federal law and the laws of the state of Washington, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Blancsom.

DISPUTES

Any dispute or claim relating in any way to your visit to Blancsom or to products or services sold or distributed by Blancsom or through Blancsom will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (such cas injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
